I have earned income from salaries & Commission & brokerage 194H from the same employer the details are as follows: Salary Income: Rs 7,20,000 Commission & Brokerage: Rs. 1,00,000
My TDS deducted for salary Rs 76000 & on Comm.Rs 10,000.
I didn't file my ITR upto till date. Pls suggest which ITR needs to be filed and how computation of tax calculated.
Can I shown my Comm. Income under Other Sources income as I earned first time. So I can enable to file ITR -1

since the employer has treated you as a professional/external consultant with respect to the commission income, you need to file ITR 4.
You also claim expenses incurred to earn such commission/ brokerage income

Sir, I have been working for a concern & thereafter I will get comm. income. My 26 AS shown income from Sec 192 & 194H separately and tds certificates given by my employer itself. I have no other business.

had commission income part of your employment terms, your employer would have added it to your salary. But since he hasn't please go ahead and file ITR4. it is beneficial to you as you can claim expenses against it.

Dear Sir, I don't have any business & I have earned Commission income from my employer which will already stated in my appointment letter.
But My employer issued separate form 16 for salary income & form 16a for comm. income.

See, by deducting tds under 194H your employer is suggesting a separate relationship on principal to principal basis unlike employer employee relationship.

When a deductor deductees TDS under sec 194H then it is deemed to be business income irrespective of your dedcution done by your employer.
So file itr-4 only as disclose both salary and business income.
