assessee has received royalty from foreign country, whether they will be liable, to pay service tax and vat

No vat and service tax payable on royalty received from foreign country. Only income tax payable.

thanks... but what are the conditions to be fulfilled for such non taxability regarding service tax and vat respectively.
if there where can I find them.

Taxable territory for Vat and service tax is India. You are receiving royalty from outside India for knowhow/patent sold outside India.
