Dear Experts! A company's legal name is different than it's Trade name. Is it legal. If we do so than any possibility of consequences!

Hello Karan, Trade name is the name entities use to operate and promote their businesses on. On the Other hand Legal name is the name legally registered with the concerned registering authority. Say if you talk about GST, you an Change your Trade Name as per your requirement, but change of legal name shall not be allowed for a given entity as it take the PAN database for Legal name and legally an entity can have a single PAN in its lifetime. Similarly it goes with other relevant laws. Thus its quite clear that the Trade Name is different than Legal name and can be changed over, as per process, during the lifetime of an entity. There is no such law which restricts the nomenclature of Trade names and so there arises no Legal consequences on the same. Hope this clears your query. Feel free to reconnect. Regards:

Ohkkk! Sir one more query suppose my company is registered in GST with trade name A2Z international ltd. Since company is engaged in mfg of agriculture equipment but now company has started the mfg of pesticides also. Hence we want to issue the invoice of pesticides say A2Z pesticides ltd. Instead of A2Z international ltd. With same GSTIN like A2Z PESTICIDES LTD. A UNIT OF A2Z INTERNATIONAL LTD.

Dear Karan, The Trade name is Printed on the GST Registration Certificate and on any given date the drawer of invoice is supposed to use the Trade Name printed on the latest GST RC. Now on any fine day, if there is any change required on such trade name or invoicing, first the Trade shall be registered with GST via filing amendment, and once the new RC is issued by the department, the company shall start using the new Trade name on its invoices. In your case, you shall first apply for the amendment of Trade name with GSTN and once approved and new RC issued, than you can use the new name. Also, trade name as per latest RC shall be used for invoicing.And invoices issued with wrong inputs may attract penal action under the GST Law. Hope this clears your doubt. Feel free to reconnect. If it is two different companies registered with MCA (ROC), then two GST registrations mandatory. You can use brand name in your invoice, but registered office address and GSTN must disclose in all your commercial invoices.
