Tax treatment for Person of Indian origin staying in India

06 February 2024 Hello CA Club Tax Experts:

Current status: OCI holder with foreign residency.

As we approach retirement in the next few years, we are exploring options of staying in India for extended periods of time, for example, for a few weeks to few months.

What would be the tax implication for us in India and our home country of citizenship if we stay in India for 3 months or 6 months or more in a year? We have foreign passports with an OCI card.

07 February 2024 Overseas Citizens of India (OCI), or Foreign Citizens and who are residents of India for more than 182 days have to pay tax and file income tax return in India. The income tax filing is usually based on his/her global income and is subject to the conditions of DTAA (Double Tax Avoidance Agreement).
