A company had filed a belated return of income for which the Tax Liablity was found out to be say 10 Rs. Later it filed a revised return for Rs. 5/- The IT Dept had sent a scrutiny notice based on the first filed return(Rs 10). When the Company approached the Dept, they told that the revised return was useless as the first filed return was belated. Does the Company have any basis to succed on this case? Any case laws would also be appreciated.
