QUERY REGARDING VIVAAD SE VISHVAS SCHEME

08 May 2020 IN OUR CASE, THE CIT(A) ORDER HAS BEEN PASSED ON 17.12.2019 AND ON THE DAY OF 31.01.2020, THE TIME LIMIT FOR ITAT APPEAL IS STILL PENDING. BUT TILL TODAY THE ASSESSEE HAS NOT FILED ANY APPEAL.
CAN THE ASSESSEE OPT FOR VSV SCHEME ? AND IF YES, THEN GUIDE US THE PROCEDURE FOR THAT.

I have gone through your shared link, but my query is still not resolved.

My query is -
A) Before 31.01.2020, my case was decided by the CIT(Appeals)
B) I have 60 days time limit for filing the appeal against that order in the Tribunal
C) But I have failed to file the appeal till today [i. e. after 60 days time limit] due to some reasons,
D) My VSV Application is also not filed till today

then -
1. Shall I be eligible for VSV Relief?
2. Whether I have to file an appeal to Tribunal by today with condonation of delay and then applied for VSV Scheme? Or only VSV Application is enough?


13 May 2020 1 yes you are eligible.
2 Only VSV application is enough. You can say instead of going for appeal opted the scheme and not filed the appeal.
