08 January 2015 Dear Sir,

I have a client who has company outside india and he got contract from Reliance industries. On behalf of his company he came to india and completed his contract which took for a period of more than 182 days in a year. As per our income tax rules he will be considered as resident and he will be liable for Income tax on his earnings. Reliance company did not deduct any tax on the assumption of his stay will not be more than 182 days.

Here are my questions

1. Is there any formalities need to be done before getting any notices or issues from the government.

2. Can he take all his money earned to his country without paying any taxes in india.

3.What kind of declarations need to get from the company.

08 January 2015 Reliance company has to do TDS.
1. Without waiting for notice tax has to be paid.
2. He can't take money without paying taxes. Before remittance certificate from CA is required for compliance of tax laws.
3. Company has to declare the payments made to him.

Thanks for your answers.

If reliance is not paying him directly all payments are remitted to his company and he is getting from his company not in india in his country

In the above case how can we go forward

09 January 2015 Even in that case the earning is for the services rendered in India and he is resident he is liable for tax.
