Income tax return filing of deceased

11 January 2018 Sir,

The assesse died in yr 2013 , but mistakenly the incometax returns for the assesse were filed in his name for the next 2 yrs. So, now how can the return be filed as still interest income arises on the name of the deceased assesse and even aadhar number are now required to be updated while filing return.
Kindly provide the solution for the same.

11 January 2018 No need to file return in the name of deceased for income arose after the date of death. Return to be filed in the name of beneficiary only.

11 January 2018 The income is to be considered of the legal hiers of the deceased and not the person who died so no need to file return of the deceased.

TDS had been deducted for FY 17-18 on the name of the deceased . so please let me know how can i claim the refund of the same???

11 January 2018 Ask the bankers to correct the TDS return by changing legal heirs PAN.

11 January 2018 As return cannot be filed for deceassed pls meet the AO and resolve.

What about the returns that had been already filed for past 2 Yrs???
And Bank is not ready to change the TDS return ???

So, let me know what can be done?

11 January 2018 Meet AO and resolve...by meeting bank manager it wont be solved.
