GST on download of foreign software

Is GST on RCM basis applicable if I download software from foreign suppliers?

What if it is downloaded by Non GST holders?

Also if any commission is earned by any Indian resident, will that be treated as export of services?

13 October 2022 1 GST under RCM applicable in case of GST holder. RCM not applicable in case of non GST holder.
For such commission income forward charge applicable in view of intermediary service
