Form 24AA - Preservation

01 April 2010 Dear Sir/Madam,

The Companies (Preservation and Disposal of Records) Rules, 1966 mentions only 4 docs.

Are there any Rules for the complete list of docs and records under CA Act?

As per Sec.299 the Form 24AA for a prticular financial year gets expired on 31st march of the year, can this mean we can destroy the forms as they have expired and keep only the latest Form 24AA declaration?

Kindly clarify.

01 April 2010 Section 299 states that disclosure needs to be made every year and Section 305 states disclosure to be made if any change is there during the year. This does not mean that after the closing of year such notices can be distroyed.

As 301(3) register is made on basis of this notices which is required to be maintained permanently. It is advisable to preserve permanently or atleast for past 8 yrs

01 April 2010 It is a record forming part of the register to be maintained under section 301(3). So, according to my understanding, form 24AA should be preserved for 8 years being an unclassified item which can be grouped under the head'any other statutory register/record.
