The assessee is a doctor and at present he is in USA .He wants to remit the money to India. The following is the query:

1) whether the remittance is taxable in India, if the money received in USA is
(a) Salary (b) Stipend

2) If it is not taxable, so how can the same be demonstrated to the Income tax officer's

[The reason for posting this query is , recently when the assessee remitted the money in his father's a/c the ITO demanded tax on the same]
Require a details answer

12 August 2010 1) money is not taxable if he is non-resident as per income tax act.
2) if he is NR then any income having no source in India can't be taxed in India.

thanks for the reply and the assessee is a NRI.


03 October 2021 For the recent query from ITD, father can reply that the remittance is gift from son, and hence not taxable.
