Excise -Cenvat credit

16 June 2008 1. Excise duty before the registration is it allowed to take cenvat credit ?

2.can you please provide me the excel formats
of RG 1, RG 23part1 & part II

3. if the company is having the enough cenvat credit is it necessary to maintain a PLA?

4. Excise duty on the spare parts purchased for the maintenance of machinery, is it eligible for cenvat credit under input or in capital goods?

19 June 2008 please clarify

03 April 2011 You can take cenvat credit of opening stock input and that should be use in final product after registration.
pla must maintain you submit nil.
you can take cenvat credit but it should come under defination under capital goods definition.
2) Define “capital goods”

“Capital goods” means

i) all goods falling under Chapter 82, Chapter 84, Chapter 85, Chapter 90, Chapter Heading No. 68.02 and Chapter sub-heading No. 6801.10 of the First Schedule to the Central Excise Tariff Act, 1985;

ii) Pollution Control Equipments;

iii) Components, spares and accessories of the goods specified
at (i) and (ii) above;

iv) Moulds and dies;

v) Refractories and refractory materials;

vi) Tubes and pipes and fittings thereof and

vii) Storage tank

used in the factory of the manufacturer of the final products but
does not include any equipment or appliance used in an office.
(Rule 2).
