E-filing of Income Tax Return

08 May 2009 -What are the consequences if I.Tax Department is not ready to accept the Copy of E-filing Acknowledgement after expiry of 15 days of time even after giving in writing the valid reason for delay by the assessee ? Whether the Return will be considered as invalid?
-What happens in the case Department has already accepted E-filing Acknowledgement after 15 days. Still it would be considered as invalid at the time of assessement?

08 May 2009 If IT department has not accepted the e-filed acknowledgement the return e-filed will be treated as a return 'not filed' and accordingly all other consequences will follow.
If it is accepted after 15 days the date of acceptance will be treated as the date of filing of the return.

08 May 2009 IN MY OPINION, DEPARTMENT CAN NOT DENY TO ACCEPT E RETURN ACKNOWLEDGEMENT EVEN AFTER 15 DAYS. VALDITY OR INVALDITIY IS ANOTHER QUESTION BUT DEPARTMENT CAN NOT REFUSE TO ACCEPT


08 May 2009 I agree with Manoj SIr. Deptt can't refuse to accept such return, because it shall be treated as return filed on the date on which it was physically submitted. No question of rejection arises.
