This query is : Resolved

25 September 2010 Dear Experts,

Assessee has paid total Rs 5515 (Rs. 5000+ service tax Rs. 515) towards mediclaim on his life. My query is whether to claim Rs. 5515 paid for mediclaim as deduction u/s 80D or Rs. 5000 i.e. excluding service tax.

Plzz clarify it as i need clarification urgently.

Regards,
CS Manish Soni

25 September 2010 YOU CAN CLAIM THE DEDUCTION OF RS. 5515

25 September 2010 Support the observation of Mr. Navin jain. The reason is, the section had never used the word "insurance premium" where as the words in the section are "amount paid to effect or to keep in force an insurance" meaning thereby the eligible amount can include the service tax portion also which is being paid to keep in force the insurance.
