04 February 2016 Hi everyone
I have a query regarding the TDS deduction on the income received from the previous employer.

Please understand my query with an example.

An employee worked with previous employer for only 9 months in the current F.Y he was getting 20000 Per month. The total he got Rs 180000/-
In the current employer he is getting a salary of Rs 30000/- and for 3 months he will get 120000/-
So the current employer takes the salary income of previous employer and deduct the TDS or he just calculate the taxation amount on his given amount of salary to his employee.

04 February 2016 Employer may not required to deduct tax as it has not exceeded basic exemption
.
however employer need to disclose salary received from both employers and pay tax if any,

04 February 2016 Thanks Ganesh ji for your reply. But i am confused on the point that current employer will calculate the TDS by taking the Salary received by the employee from previous employer.

04 February 2016 Current employer takes the previous employer salary income, based on form 12B furnished by the employee and deduct TDS including that income as per section 192(2).

04 February 2016 If you have disclosed such details they can consider this and may deduct tds accordingly ,but your current employer should take proper care in cacluculation of taxable salary, considering hra exemption,pf deduction in 80c,etc
.
there is no rule to restrict your current employer from deducting tds in this case,in the same way nothing will happen to your employer if he avoid tds
