The TDS for the AY 2012-13 is not yet paid by my employer eventhough the same has been deducted.

Shall I claim credit for the same from my tax while filing the return. Please advice.

27 July 2012 Yes claim it. When your employer pays the TDS and files form 24Q you will get the credit of TDS deducted from you.

Agree, but on the safer side I advise you to pressurise your employer to file TDS return asap.


28 July 2012 Thanks for the reply. The problem is the company is having time up to September 30 to clear the TDS dues with interest. But our case we need to file the return before 31st July.

Also want to know about any restriction in filing return without any reference of Form 16/16A because I have the figure only no certificate is available with me.

28 July 2012 yes. you can file the Income tax return. but ensure you have any evidence for employer deducted TDS from your salary ( it may be form of Payslip or any other documents) since you are not having the form 16. also insist your employer through written communication to deposit the TDS on or before filing date for further proof incase if your employer not deposit the TDS till assessment
