Dr. deepika a dentist,want to file ITR.she has her own setup clinic and earns from consultancy fee and minor operation of teeth.she has no TAN for service tax as she earn from regular dentistry. she has no book of account and audit.her turnover is less than 10 lac. can she file ITR 4S (presumptive income)

No, She has to file her return of income in ITR-4 as the basis of her gross receipts and expenses, Because of Doctors comes under category of Professionals and for professionals section 44AD(presumptive income) not applicable and ITR-4S shall be file those who offering their income u/s 44AD.
So in your case she has to file ITR-4 and as per section 44AA if her gross receipts is below 10 lacs and/or total income doesn't exceeds Rs.1,20,000 in any of the immediate preceding three years to the current year then need not to be maintain regular books of accounts. NO UNDER INCOME TAX ACE U/S 44AA SOME BUSINESS ARE SPECIFIED . WHO MAINTAIN SPECIFIED BOOKS FOR HIS BUSINESS /PROFESSION. DOCTORS, SCIENTIST, ENGG. ETC ARE SOME SEPECIFIED PROFESSION. WHO MAINT THE BOOKS OF ACCOUNTS
SO YOU CAN NOT FILE THE RETURN UNDER 4S YOU HAVE TO FILE FORM 4 AND IF YOUR RECEIPTS EXCEED RS. 25 LCAS FROM F. YEAR 2012-13 THEN YOU HAVE TO AUDIT YOUR BOOK U/S 44AB.
