IT filing for deceased

23 December 2010 One of my client's(lady) land was acquired by Govt under cumpulsory acquisition and issued cheque for the amount after deducting TDS in Apr,08. She was a house wife and does not have any other income. She died in Aug,2010 and has not filed IT return for FY 08-09 claiming refund for the above. Now, can her husband file the IT return on behalf of her and get refund and what is the procedure for that?

23 December 2010 Within the due date if an assessee file his returns only he can able to claim the refund In this case the due date for filing havebeen lapsed so her husband cant able to claim the refund

23 December 2010 This is strange to hear that for claiming of refund, the assessee has to file his return within the due date. I have filed many of my assessees IT return after due date and got the refund. Kindly validate your answer again.


23 December 2010 Upto 31.03.2011, you can file the return and claim the refund and her husand will be A.R for the said F.Y

09 October 2021 Yes, refund can be claimed, even if return filed belated u/s. 139(4) of IT act.
