General Manager of a company was sought to be prosecuted for return of a cheque given by the company to its transporter. The General Manager did not sign the cheque. He was also not in charge of the affairs of the company. He was also not issued any notice in regard to the dishonour of the cheque. Under the circumtances can the general manager be prosecuted ????

On the understanding that the general manager neither issued the cheque on behalf of the company nor incharge of the affairs, he cannot be prosecuted for the dishonour of the cheque so issued.
