08 July 2011 When bank deducts TDS from the taxpayer, but do not deposit tds with government, then who is held responsible? Can a taxpayer declare ITR without showing tds on FD?
HOw to tackle this matter? I heard that a tax payer cannot open a case on the bank for not depositing tds with govt. Is it true. If taxpayer is not the appropriate person to file a case on the bank then who else is capable? How to act in this matter? Can a tax payer directly report the matter to the incometax office?
Please suggest.

08 July 2011 if you have submitted your PAN card to bank for opening any TDR, and same is mentioned in your TDR account, then bank has to furnish form 16A as certificate of deduction.

you can lodge complaint chronologically to
1) your branch manager
2) head office of the bank
3) banking ombudsman of your city
4) CIT(TDS) of your zone

attatch the form 16A as record of deduction and 26AS as non reflection of tds so deducted.

08 July 2011 Thankyou very much sharmaji. I do take your suggestions into consideration and tackle this matter, but I am worried about the less time available to declare ITR which is 31st july. I donot think that the matter can be closed in the coming 15days..

ombudsman services are just excellent and in two weeks from receipt of your complaint they will forward the same to your banker with copy to you, which will force your banker to comply instant.
