27 December 2013 We want to liquidate a private limited company. Who can be appointed as liquidator? whether a practicing CA can act as liquidator? Or how to appoint? Please provide the details about liquidator.

27 December 2013 A member from the panel of the professional firms of chartered accountants, advocates, company secretaries, cost and work accountants which the central government may constitute. Body corporate approved by central government. Whole-time or part-time officer appointed by the central government.


Yes. A practicing CA can act as liquidator. But he needs to be empaneled for the same.

27 December 2013 There is an official appointed by the Union Govt designated as Official Liquidator.High Courts also appoint a person as liquidator or Receiver of a sinking company.This is a very long process,often requiring court approval for closing the matter. It involves,realisation of maximum amount from the proceeds of disposal of properties and dispensing wih all liabilities in the legal order of prefernce......mjk

But i had understood,
that criteria would apply for official liquidator in case of winding up by court order.

Is that the same for voluntary winding up also?

27 December 2013 in case of voluntary winding up, company shall appoint the liquidator. refere section 490(1).
