Whether RENT paid to wife is allowed for HRA?

15 April 2008 Query is the whether rent paid to wife (House was in the name of wife)is allowed for claiming exemption under HRA, and if a person claim exemption since last 4-5 years ,than what he do?

and tell me that if there was no proof the from where the house was come to the wife

15 April 2008 yes ,it is allowed.



16 April 2008 rent paid to wife for house is eligible for claiming exemption .
this aspect is different from the other issue of source for the house in the name of wife.
if source cannot be explained to the satisfaction of assessing officer,then he may treat the same as unexplained income and tax HER accordingly.
in the alternative if the assessing officer is FULLY satisfied that the source is traced to the husband, he may apply clubbing provisions under sec 64 and the income is treated as income of husband and add the same to husband's income and tax accordingly.
