a cooperative soc has given the work for building renovation to a contractor for contract value of Rs. 50 lacs. the above soc. is regd under Cooperative Soc Act but not under MVAT Act.Whereas the contractor is regd under MVAT Act.
Is the soc liable to deduct & pay vat tds??? If yes then what is the procedure to pay the same and whether the soc has to get regd in MVAT.

DEAR, AS PER YOU ,THE SOCIETY GIVEN CONTRACT TO A CONTRACTOR,RIGHT,NOW YOUR QUESTION IS THAT THE SOCIETY IS TO DEDUCT TDS AND MAKE THE NET PAYMENT.WHENEVER SOCIETY IS NOT REGISTERED FOR THE TDS. SO THAT AT FIRST YOU APPLIED FOR TAN NO.FOR THE SOCIETY AFTER RECEIVING THE TAN THE SOCIETY WILL BE ABLE TO DEDUCTED FROM CONTRACTOR AND TDS AMOUNT DEPOSITED TO THE DEPPT.
