VAT RATE WHEN NO C-FORM CUSTOMER CAN ISSUE

30 December 2010 If a dealer is selling to a cusotomer, out of Maharashtra, who is unable to issue C-form,Whether VAT rate should be only 5% when actual VAT is 12.5%

KINDLY GUIDE ME IN THIS REGARD.

goods sold with out C form it is applicabel of local rate VAT (i.e 4% or 12.5%)
