IF THE PREVIOUS AUDITOR HAS FILED FORM NO 23 B WITH ROC , (WHILE ACCEPTING THE ASSIGNMENT AFTER BEING APPOINTED BY THE COMPANY),THE AUDITOR CAN NOW GIVE NOC TO THE NEW AUDITOR.AS MR NAVEEN SAID RIGHTLY NOC IS THE ONLY REQUIREMENT AS PER THE LAW AND ICAI GUIDELINES. WE COME ACROSS A FEW CASES WHERE DUE TO NON FILING OF FORM 23 B AT THE TIME OF APPOINTMENT ,THE OLD AUDITOR SOMETIMES FACES A PECULIAR SITUATION BEFORE GIVING NOC. THERE ARE ALSO CASES WHERE THE FORM 23 B WAS FILED AFTER LOT OF TIME LAPSE .REMEMBER IT IS ONLY AN INTIMATION TO ROC. AS FOR OTHER DOCUMENTS EVEN THE ICAI DOES NOT DEMAND FROM OLD AUDITIORS -THE OLD WORKING PAPERS OR AUDIT NOTES ETC...THIS IS A MATTER OF COURTESY BETWEEN THE OLD AND NEW AUDITORS. R.V.RAO
