I want experts view on the following ( society is located in Mira Road)
In the Annual General Meting of the housing Society the Members wish to pass the following resolution due to increasing cost and lack of fund in the society account. Can a society pass such resolution and charge such amount from outgoing /incoming members?
What is correct charges to be collected from outgoing/incoming members as per the By-laws. What are the proper options to increase the fund of society. Members are requested to advise under the reference to By Laws of the Marashtra Housing Society Act.
Due to increasing cost of electricity/water ,security , building maintenance from time to time it was decided to charge Rs.25,000/- as Transfer Premium & Rs. 25000 as Building Repairing fund from the members who sell /purchase their flat/shop, as these members are earning premium in their deal also , and to raise the fund to cope of the increasing cost of maintenance.
“It was Resolved that Rs.25,000/- as transfer premium and Rs. 25000 as Building Repairing fund be collected from outgoing /Incoming Members of the Society who sell /purchase their flat/shop”.

Maximum transfer premium is Rs.25000 that is legally binding to all members in case of transfer of flat, if they approve the motion in the general meeting.
