Transfer and Extension

This query is : Resolved

28 July 2021 I am currently serving my last year of articleship but I m registered through Direct Entry Route and still I don't clear my CA inter attempt . My articleship is due for completion on 31/01/22. But I want to take transfer and also I have excess leaves of 300 days, can I take transfer?

In July 2021, I have already given my ca inter attempt. due to lack of work or i didn't learn anything from my principal what reason I have to give my transfer form?

Is it compulsory that I have to serve my extension in the same old firm?

Due to covid-19, my leaves increases by 60 days, what should I do in that case? I have already taken leave before covid-19 came in India.

Please advice

11 July 2024 Based on your situation as described, here are some key points to consider regarding your articleship transfer and leave issues:

1. **Transfer during Last Year of Articleship:**
- As per ICAI regulations, you are allowed to take a transfer during the last year of your articleship. This transfer can be for reasons such as lack of work, non-learning environment, or personal reasons. You need to provide a valid reason in your transfer application.
- Since you have completed the direct entry route and are in the last year of articleship, you are eligible for transfer. Excess leaves do not prevent you from applying for a transfer if you have a valid reason.

2. **Reason for Transfer:**
- Given your situation, where you have completed attempts for CA Inter but have not cleared, you can mention reasons such as lack of work, non-learning environment, or the desire to gain diverse experience in another firm.
- It's important to substantiate your reason with specific details about the work environment, learning opportunities, or any other relevant factors contributing to your decision.

3. **Extension in Old Firm:**
- No, it is not compulsory to serve your extension period in the same old firm. You can apply for a transfer to another firm to complete your articleship, especially if you have valid reasons such as those mentioned above.
- Ensure that the new firm you wish to transfer to is willing to accept you and that you comply with the necessary formalities for transfer.

4. **COVID-19 and Leaves:**
- Due to the COVID-19 pandemic, many students faced challenges in terms of leave accumulation and disruption in work. If you have accumulated additional leaves due to COVID-19, you should document this appropriately.
- When applying for a transfer, you can mention the impact of COVID-19 on your leave accumulation and how it has affected your articleship tenure.

5. **Procedure for Transfer:**
- Contact your regional ICAI office or check the ICAI website for the specific procedure and forms required for articleship transfer.
- Prepare your transfer application with clear and valid reasons, attach any supporting documentation if required, and submit it to your regional office for approval.

In conclusion, you are eligible to apply for a transfer during the last year of your articleship, and excess leaves or COVID-19 related issues should not prevent you from seeking a transfer if you have valid reasons. Ensure that your application is well-supported with documentation and that you follow the procedure outlined by ICAI for smooth processing of your transfer request.
