Sir,I have completed 1 year & 4 month of articleship and i m registered in khandwa and from 1 month i am suffering from the problem of stone in the kidney, due to which i am unable to continue the articleship in foreign city so i want to take transfer in my home town in indore city (distance of khandwa to indore-131 km).as that i am unable to travel in foreign city
it would be possible for me to continue my articleship in indore,
my boss is ready to give me transfer
plz reply , would it be sufficient reason for getting the permission to take transfer from ICAI ???????

There is not time limit to re-join into articleship after taking termination it is your choice but as early as possible registration is better to your future because of saves time etc.....
Effect of termination on CA final exams eligibility is depending on the time gap between termination and re-registration and commencement of your articleship training date and your leaves etc....
So in one word i can say yes, there is chances to effect ca final exams but this control is only in your hands.

Is there any criteria that on taking transfer in this way I have to take leave for 3 months and only after that I can re-register in a new CA firm ???
16 April 2014
Yes, with your interest at any time you can re-register to your articleship to complete remaining period of articleship training as your convenient, But delay in re-registration to articleship may extend your eligible attempt of CA Final exam.
16 April 2014
The period between termination of articleship and re-registration to articleship is considered as break in articleship training not the leave(means doesn't considered as articleship training period) i.e straightly we say due to the delay in articleship registration after termination should be increase your articleship completion period but while leaves shall decides either extend our articleship period or not at the end of the completion of articleship period based on the total leaves during that period.
Yes, if you want then you can re-register to articleship immediate day to the termination date.

So if you want then you can take gap between termination and re-registration i am not saying this delay period as leave because of above i said.

Is it correct in case 0f transfr due to medical reason
23 April 2014
Yes, it is correct, just know i again read about the articleship termination conditions after one year notification issued by ICAI,it clearly indicated must and should be give break of minimum 3 months of articleship training if the termination is on the grounds of medical reason
previously i saw another one which published by others other than ICAI notification in that file there is not clarification about it now by the question of you i search for the ICAI original notification and got it, however because of your query i have updated my knowledge.
Yes, ICAI is correct, to get termination on the grounds of medical should be required to have gap of 3 months to get re-registration to articleship.
