We had applied for the name availability for a Pvt. Co. on 19 th February 2009 and got the name approval on 24th Feb 2009 but due to some reasons, we cannot file form 1,18,32 and other documents with ROC......and the name got expired on 20 May 2009...
So in this case we didn't had 6 months time for submission of documents with ROC.Can u tell me the section which speaks of the 6 months time for submission of documents after name approval??
6 months is super 100% confirm. You may refer any good law book.
Confirmation of the availability of name by the Registrar
On receipt of the application in e-Form 1A, electronically, the Registrar shall provide a letter for his conformation or observations regarding availability of name as the case may be. [Rule 4A of the Companies (Central Government) General Rules and Forms, 1956]
On receipt of confirmation for availability of name, the promoters should submit all the required documents with the Registrar of Companies electronically to register the company with that name provided within a period of six months from the date of intimation by the MCA, otherwise the confirmation shall lapse automatically. In such a case, a fresh application to Registrar shall be made for extension of name with filing fees of Rs. 500, confirmation of availability of the same name or another alternative having a further validity of six months.
