TDS on medical payment

25 June 2010 Hi!

Can u please tell me that if i (private company) is making payment to a hospital for the medical treatment of our employee and later on we recovered the amount from employee then whether liability for deducting TDS arises while making payment to the hospital or not?

25 June 2010 No.For hospital payments not attract TDS under any section

25 June 2010 But if payment is made by TPA's then TDS will be deduced as per notification, then why TDS will not be deducted if payment made by a private company.

26 June 2010 The company is not booking any expenses in the books of account and since TDS should be deducted on the expenses only TDS not applicable.


There is a CIRCULAR NO. 8/2009 [F.No. 385/08/2009-IT(B)], DATED 24-11-2009 for Section 194J of the Income-tax Act, 1961 - Deduction of tax at source - Fees for professional or technical services - Applicability of provisions under section 194J, in the case of transactions by the Third Party Administrators (TPAs) with hospitals etc.
