Tds on advocate

15 April 2013 We have paid Rs.40,000/ as fees to Advocate during (Feb Rs.20000/, March Rs.20000/) is this applicable for TDS? If its applicable in Which Section, What is the rate. My Superior told as per Supreme court order the Advocate fees is exempted from TDS. Please suggest me.
