Tds of interest payment

05 March 2014 during the F.y 2010-11 a company had paid interest amounting to Rs. 31 lakhs to NBFC.
and didn't deduct TDS thereon .

out of Rs. 31 lakhs no amount was payable.


now please tell can we take stand of the paid and payable controversy as decided by some case laws like merylin shiiping , vector shipping??
