TDS deduction

06 December 2008 Respected Sir,

I am currently getting my remuneration in the form of professional fees. My gross total income during the year is not taxable.
But i am getting the remuneration after deducting the TDS (@10.24%)

I Know that i can file the Income Tax Return seeking the refund of the TDS deducted.

But my query is that "is there any form / declaration available under the Income Tax or relevant Act where-by i can seek No TDS deduction or deduction at a Lesser rate.

06 December 2008 You may submit Form 13 to your jurisdictional ITO and get a certificate for no deduction of tax and submit the said certificate to your employer. If it is done employer will not deduct tax.

06 December 2008 the correct rate is 10% plus 3% ed.cess i.e. 10.3%

06 December 2008 yes you can submit form no 13 to the ITO officer where you are assessed with calculation of tax payable on your income ,likely tax to be paid thereon , tax already deducted ,remaining tax to be paid in support of lower rate or no tds at all .
if assessing officer is satisfied he will issue certificate to the dedutor to deducte tds at the lower rate or at nil rate .
