Tds applicable or not on foreign commission agency?

We are manufacturers and exporter. we got an order from Turkey through our foreign agent located in UAE. So my agent of UAE is demanding 5% commission against our export to Turkey..... So TDS is applicable or not on Agent ? And if Yes- What is the rate to be deducted? And if No- Reasons...?

Ideally no if agent is not coming to India or not providing any services in India.
