Under Section 195 income of Non Resident which is taxable in India is subject to Tax Deduction.If the payer of income is in doubt as to whether whole of such income is taxable or not then he can apply to A.O u/s 195(2) and then will deduct TDS on only that portion of income which will be taxable in india.
