04 January 2008 Respected Seniors,

1.If employer deduct the TDS from my salary, can I claim against that

04 January 2008 There is no legal right in Act for wrong / Excess deduction of TDS by the company on your salary, in the Act.

You can claim in your Income Tax return.

07 January 2008 How can I claim

07 January 2008 By fiing your income tax return , you can clain refund of excess TDS if any

15 January 2008 thanks

17 March 2008 and that refund you will get from the govt not from the company

17 March 2008 If your emplyer has deducted TDS then TDS is your asset. At the time of filling your return, you have to pay less Income Tax by that amount of TDS and If your tax liabiliy is less than your TDS then you can claim refund from the I.T.D. As an example your employer has deducted TDS of Rs.2000 and your tax liability comes to Rs.2500 then you have to pay only Rs.500 (2500-2000) as an income tax but if your tax liability is Rs.1200 which is less than TDS then you can claim refund of Rs.800 (2000-1200). I hope your querry may be resolved.
