Stamp duty on waiver of right

19 March 2013 On death of father daughter has received share in ancestral property
Now, she wants to renounce her right in the favour of mother so this can be done without payment of stamp duty..,?

Hakkami Agreement or Something of that sort can be entered as an alternative to payment of Stamp Duty..?

18 July 2013 This is to be done through relinquishment of rights by way of an agreement and on payment of stamp duty. It cannot be done without payment of stamp duty.

Yes it would be nominal stamp duty for registration of Relinquishment deed and same should be check with Sub-Registrar Office. Every state having stamp act in that for various conveyance deeds stamp duty charges are mentioned except sale deeds.

The stamp duty differs in State tio State and accordingly in which State it is to be done is not mentioned by you.


As per The Indian Stamp Act, 1899 as applicable in Uttar Pradesh, you have to pay stamp duty @7% and As per notification 1% stamp duty remission to woman upto 10 lacs value of Property
