Service tax Refund in case of office rent paid

Urgent!!!

I would like to know that can a private limited company take refund of service tax on rent of office premises? How?

The company has no domestic revenue against which we ca claim set off, then how can we get refund of this? Ours is a software company serving all out of india clients ,registered under STPI.

16 September 2009 no, u can't cliam the refund of service tax.

16 September 2009 I think you are a receiver of the service.

I feel, one must file refund claim for service tax paid on renting of commercial property, in view of the recent Delhi High Court's ruling.
