WE ARE MGF PVT LTD. CO. WE HAVE GIVEN A FLAT ON RENT TO PANASONIC CO. PVT LTD. PANASONIC CO. IS USING THIS FLAT FOR RENTING OF THEIR MANGER FOR RESIDENTIAL PURSPOSE. SO I WANT TO KNOW IS THEIR SERVICE TAX IS APPLICABLE ON THIS FLAT. BECAUSE AS PER MY KNOWLDGE SERVICE TAX IS NOT APPLICABLE ON RESIDENTIAL FLAT

I feel it will be taxable services as what is given under negative list residetial dweeling used for residential purpose. Now this is case of useing the flat as guest house so it will be commercial purpose & hence it is taxable output services. Arvind Tiwari 09322368699

Even if the flat is used by company as a guest house, company is not renting it to distinct service recipient. Secondly it is used for residential purpose. So in my view it is non taxable.
