Service tax for us client

07 November 2014 Dear Seniors ,

My company is in Indian software company.I want to generate invoice for one of my client of USA for software our services.

My doubt is,Can i enter service tax 12.36 % on service charges or not?

Please help me on above.

07 November 2014 01. What are your NEGOTIATED terms? Is upcountry client going to pay you the Indian taxes?
02. As per the POPS (Place of Providing service), your company has to pay the service tax.
03. The terms of your contract with your client will decide whether you can get it from your client or not
