Service tax excess paid

if service provided by the service provider for rs 500 and paid the service tax on the same amount later on only 250 is recd from the service recipient .. then what are remedies available to the service provider ..
1. is he liable to book cenvat credit or to get refund of excess paid service tax if yes,, then under which provision??

No that will be treated as bad debts to him incl ST portion
