The department has decided scrutiny norms for AY 2008-2009.
If a case has been selected for scrutiny which does not fit in scrutiny crieteria then can assessee question this before AO and can he get notice u/s 143(2) withdrawn. Is there any legal remidy for this ?
Yes, you can give a letter with detail guide lines issued by CBDT for withdrawing the notice given u/s 143(2). If AO not ready to withdraw the notice, you may ask direction to Joint CIT u/s 144A.
I had similar issue in past and approch to Joint CIT u/s 144A. He issued a direction for withdraw the notice issued u/s 143(2).
