Salary of a soldier

19 July 2014 Sir,
with due respect,salary is paid to a soldier and TDS certificate is issued by the deductor but the TDS is not reflect in 26as of soldier .I connect to ITO office and asked about refund of soldier . But i could not find the correct answer.Is that TDS is refundable ??

19 July 2014 TDS is refundable if it is in excess of the tax liability for the year. After CBDT instruction No. 5/2013 F.No.275/03/2013-IT(B), dated 8.07.2013, where tds credit is not properly reflected in the Form 26AS, it shall be incumbent upon the AO to give credit on the basis of documents provided by the assessee. So kindly give evidence to the AO such as salary slip reflecting tds deduction etc

23 July 2014 Thank you sir, but if tds is more then 50,000/- then is it possible for AO to release the refund.

23 July 2014 whatever may be the amount of TDS. any excess tax credit shall be refunded
