20 February 2016 can i file a revised return if my case is transferred to AO without order of 143(1)?

20 February 2016 Thanks Sir!Actually i have filed return in ITR-4 and by revisng the return it will be under salary income i.e ITR-2. i am feared about if my revised return will again tranfer to the ward or not ? and whether it will be processed or again tfr to ward as it previously done!Please guide me

20 February 2016 Revised return can be filed anytime till the completion of the assessment. The original return should have been filed under 139(1) i.e before the due date. The cause for revision in your case is filing of the wrong ITR. ITR - 2 is to be filed, if you don't have income from "Profits & Gains from Business or Profession". If you have income under that head, then ITR - 4 is to be filed.

In case your major source of income is "Income from Salaries" and you have no income under the head "Profits & Gains from Business or Profession", your return will be processed in the salary circle subject to the criteria laid down.

In case a wrong ITR is filed, but with all the correct information, then there is no need to file a revised return.

So probably your file may be re-transferred to Salary Circle, if that is the correct jurisdiction..
