Reversal of special cvd under 3(5) of customs act, 1962

08 March 2012 Can Special CVD under Sec 3(5) be reversed by the importer if he is not using the imported item in manufacture... i.e., he has made local sales and the customer here is using the product in manufacture.
Can Importer transfer the Credit to Customer?

08 March 2012 Yes CVD can be transferred to Customer subject to a declaration in invoice of trader that it will not file any refund claim for CVD
