Rent on vacant land and arrears of rent received

13 July 2013 In which head rent on land given for errecting a mobile tower is being charged?

The tower company was not paying it from the date of contract 01-01-2010. They paid all the arrears in 2013 march and deducted 10% TDS on it. As per my 26AS, income for Fin Yr 2012-13 is 533218 and TDS on that is 53322.
Can i bifurcate my income and if it it could be bifurcated i will not have to pay any tax.

13 July 2013 This income is chargable under the head "income from other source". If once assessee opt to declare the income on cash basis (as you have not declared the income on accrual basis earlier) he cannot change the method next year. As per the details provided you are showing your income as and when received. Hence right to bifurcate is not available now. As in case of J.K Bankers v CIT (1974) 94 ITR 107

13 July 2013 since landlord tanant rel is missing it cannot be chg under house property head.

It will be taxable under income from other sources.
