15 May 2015 I have taken a service tax number of a party under General Insurance business..He is selling general insurance as an agentI heard it comes under INSURANCE AUXILIARY SERVICEhow can i rectify this mistake..I have filled the st-3 for oct14 to mar15 period under general insurance head..

20 July 2025 Here’s what you can do to rectify the mistake of registering under the wrong service category for service tax:

Issue:
Registered under General Insurance Business
Actually should be under Insurance Auxiliary Services (since the party is an agent selling general insurance)
ST-3 returns already filed under wrong service head for Oct’14 to Mar’15
Steps to Rectify:
Check Service Classification:
Confirm that the correct service category is indeed Insurance Auxiliary Services (Service Code 999213 as per service tax classification).
General Insurance Business (like insurance companies) and Insurance Auxiliary Services (like agents/brokers) are different taxable services.
Filing Revised Returns:
You cannot directly change the service classification for past returns already filed.
File revised ST-3 returns for the affected periods (Oct’14 to Mar’15) under the correct service code Insurance Auxiliary Services.
While filing revised returns, you need to correct the details of taxable services and tax paid.
Adjustments of Tax Paid:
If you paid service tax under the wrong service head, the tax paid is still valid since it is tax on services provided.
You can continue with the paid tax but ensure future returns and payments reflect the correct service classification.
Inform the Jurisdictional Service Tax Officer (STO):
It is advisable to inform your STO about the correction to avoid any future disputes.
Submit a letter explaining the mistake and the corrective measures taken (filing revised returns).
Future Compliance:
Ensure all future filings and invoices mention the correct service code and description.
