REGARDING TRADEMARK REGISTRATION - PROPRIETOR CODE

This query is : Resolved

06 April 2021 Do we need to use the same proprietor code, for all applications made under the same name(same entity) for trademark(same client code for same entity for different trademarks)?

10 July 2024 Yes, typically, when filing trademark applications for the same entity under the same name (or variations thereof), it is advisable to use the same proprietor code. Here’s why and how it works:

### Proprietor Code in Trademark Applications:

1. **Unique Identifier:** Each applicant (individual, partnership, company, etc.) is assigned a unique proprietor code by the Trademarks Registry. This code uniquely identifies the applicant in their records.

2. **Consistency:** Using the same proprietor code ensures consistency across all trademark applications filed by the same entity. It helps streamline administrative processes and record-keeping both for the applicant and the Trademarks Registry.

3. **Ease of Management:** When the same proprietor code is used, it facilitates easier tracking and management of applications, amendments, responses, and other communications related to trademarks.

4. **Avoiding Confusion:** Using different proprietor codes for applications under the same entity could lead to confusion in tracking the status and history of applications, especially if there are multiple applications or if updates are needed.

### Practical Steps:

- **Application Filing:** When filing trademark applications, you should use the same proprietor code that was assigned to your entity for all applications pertaining to that entity.

- **Existing Proprietor Code:** If you have already been assigned a proprietor code for previous applications, use this same code for new applications, provided they are for the same entity (same name or variations thereof).

- **Consistency in Information:** Ensure that all details provided in the application, including the proprietor's name, address, and other particulars, match those associated with the proprietor code on record.

### Conclusion:

Using the same proprietor code for all trademark applications filed under the same entity (same name or variations thereof) ensures consistency, simplifies administrative processes, and helps avoid confusion. It’s a standard practice recommended by the Trademarks Registry to maintain clarity and efficiency in managing trademark registrations. If there are any changes or updates to your entity's details, such as address or contact information, make sure to inform the Trademarks Registry to keep records accurate and up-to-date.
