This query is : Resolved

11 February 2021 I have requested my principal to give termination during covid lockdown (july 2020) I.e before completing 1year of articleship. Principal accepted by then and asked me to work for 2months notice period. I have completed my notice period. But still he drags to give termination. My D.O.J 02-12-2019. Kindly help me Out of this.

10 July 2024 If your principal has accepted your request for termination during the notice period but is delaying the formal termination letter, you can take the following steps to resolve the situation:

1. **Document Everything**: Make sure you have documented all communications with your principal regarding the termination request. This includes emails, messages, or any written correspondence where the termination acceptance is clearly stated.

2. **Follow Up**: Send a polite follow-up email or message to your principal requesting the termination letter. Mention the agreed notice period completion and reiterate your request for the formal termination letter to be issued promptly.

3. **Seek Assistance from Institute**: Contact the Institute of Chartered Accountants of India (ICAI) for guidance. They have procedures in place for handling disputes related to articleship terminations. You can file a complaint or seek advice from them on how to proceed if your principal continues to delay issuing the termination letter.

4. **Legal Advice**: If the delay persists and is causing significant issues for you (such as inability to start a new articleship or pursue other opportunities), consider seeking legal advice from a lawyer specializing in employment or contractual matters. They can guide you on the legal options available to enforce your right to termination.

5. **Patience and Persistence**: Sometimes delays can occur due to administrative issues or oversight. Continue to communicate politely but firmly with your principal. Keep records of all interactions and maintain professionalism throughout the process.

In summary, while waiting for the termination letter, ensure you have all documentation in place, follow up with your principal and seek assistance from relevant authorities if necessary. These steps should help you navigate through the situation effectively.
