One of my friend had completed articleship a year ago but he did not submit form 108 as he had excess leave to complete, now after the completion of excess leave he has submitted form 108 but it has been rejected and he has received a letter saying he has not complied with the requirements of articles and that he has another one year of articleship to complete. Now this issue is being sorted out but does this in any way amount to professional misconduct on the part of the principle.

1. To serve the excess leave he has to enter into supplementary deed of articleship with the principle after he completes his normal period of articleship in Form No 107.
2. Also he has to do the franking of deed in triplicate which needs to be submitted to institute along with Form 107.
3. After serving the excess leave he has to submit form 108
If failed to do so then the excess leave will not be considered.
But now i guess that the person has not submitted form 107 and has served the excess leave, the only recourse is to submit form 107 with late fees, once it is approved, then submit form 108. The only problem will be the franking of deed between article and principle.
